Algemene voorwaarden

Deze algemene voorwaarden (“Voorwaarden”) zijn van toepassing op alle aanbiedingen, bestellingen en leveringen van Bondesque Magazine (“Wij”, “Ons”) aan haar klanten (“Klant”). Door een bestelling te plaatsen, gaat de Klant akkoord met deze Voorwaarden.

1. Definities

  1. Bondesque Magazine / Wij / Ons: de uitgever en verkoper van het tijdschrift Bondesque Magazine, ingeschreven in Nederland.
  2. Klant / U: iedere natuurlijke of rechtspersoon die producten van Bondesque Magazine afneemt.
  3. Product: ieder fysiek exemplaar van Bondesque Magazine.
  4. Website: de officiële online verkoopomgeving van Bondesque Magazine.
  5. Overmacht: elke omstandigheid buiten de redelijke controle van Bondesque Magazine waardoor de nakoming van de verplichtingen tijdelijk of blijvend onmogelijk wordt, inclusief maar niet beperkt tot natuurrampen, pandemieën, stakingen, overheidsmaatregelen en transportproblemen.

2. Toepasselijkheid

  1. Deze Voorwaarden zijn van toepassing op alle aanbiedingen, bestellingen en leveringen van Bondesque Magazine.
  2. Afwijkingen van deze Voorwaarden zijn alleen geldig indien schriftelijk bevestigd door Bondesque Magazine.
  3. Algemene voorwaarden van de Klant worden uitdrukkelijk van de hand gewezen.

3. Offertes en Aanbiedingen

  1. Alle aanbiedingen zijn vrijblijvend, tenzij uitdrukkelijk anders vermeld.
  2. Bondesque Magazine behoudt zich het recht voor prijzen, specificaties en beschikbaarheid te wijzigen zonder voorafgaande kennisgeving.
  3. Een bestelling leidt tot een overeenkomst nadat Bondesque Magazine de betaling heeft ontvangen en een orderbevestiging heeft verstuurd.

4. Bestellingen en Contractsluiting

  1. Een bestelling kan uitsluitend worden geplaatst via de website of andere goedgekeurde verkoopkanalen.
  2. Bondesque Magazine behoudt zich het recht voor een bestelling te weigeren, bijvoorbeeld bij vermoeden van fraude, onvoldoende voorraad, of onjuiste gegevens.
  3. Alle contracten worden elektronisch vastgelegd en zijn toegankelijk voor de Klant via e-mailbevestiging.

5. Prijzen, Betaling en Incasso

  1. Alle prijzen zijn inclusief btw en exclusief eventuele verzendkosten, tenzij anders vermeld.
  2. Betalingen kunnen worden gedaan via iDEAL, PayPal, Apple Pay of creditcard.
  3. Bondesque Magazine behoudt zich het recht voor om betaling vooraf te eisen bij grote of internationale bestellingen.
  4. Bij niet-tijdige betaling is de Klant vanaf de vervaldatum wettelijke rente verschuldigd, evenals alle redelijke incassokosten, inclusief buitengerechtelijke kosten.
  5. Bondesque Magazine behoudt zich het recht voor om bij vermoeden van betalingsrisico de uitvoering van de bestelling op te schorten.

6. Levering en Risico-overgang

  1. Levering vindt plaats op het door de Klant opgegeven adres.
  2. Risico van verlies of beschadiging gaat over op de Klant bij ontvangst van het product.
  3. Bondesque Magazine streeft ernaar bestellingen binnen 7-14 werkdagen te leveren. Bij internationale verzending kunnen langere levertijden gelden.
  4. Indien levering door omstandigheden buiten de controle van Bondesque Magazine vertraagd is, wordt de Klant geïnformeerd en kan de Klant de overeenkomst niet ontbinden.

7. Herroepingsrecht en Retourneren

  1. Consumenten binnen de EU hebben het wettelijke herroepingsrecht van 14 dagen.
  2. Het product dient in onbeschadigde staat en in de originele verpakking geretourneerd te worden.
  3. De Klant draagt de kosten van retourzending, tenzij het product beschadigd of defect is ontvangen.
  4. Bondesque Magazine zal een terugbetaling binnen 14 dagen na ontvangst van het geretourneerde product uitvoeren.

8. Aansprakelijkheid

  1. Bondesque Magazine is niet aansprakelijk voor indirecte schade, gevolgschade of gederfde winst.
  2. De totale aansprakelijkheid is te allen tijde beperkt tot het factuurbedrag van de bestelling.
  3. Bondesque Magazine is niet aansprakelijk voor schade veroorzaakt door externe bezorgdiensten, douane of overmacht.
  4. De Klant vrijwaart Bondesque Magazine tegen aanspraken van derden in verband met gebruik van het product.

9. Intellectuele Eigendomsrechten

  1. Alle content van Bondesque Magazine, inclusief teksten, afbeeldingen, logo’s, grafische elementen en digitale content, is beschermd door auteursrechten en andere intellectuele eigendomsrechten.
  2. Zonder voorafgaande schriftelijke toestemming van Bondesque Magazine is het verboden om inhoud te kopiëren, distribueren of commercieel te gebruiken.

10. Privacy en Gegevensverwerking

  1. Bondesque Magazine verwerkt persoonsgegevens in overeenstemming met de AVG en de privacyverklaring van Bondesque Magazine.
  2. Persoonlijke gegevens worden uitsluitend gebruikt voor het verwerken van bestellingen en klantenservice.
  3. Bondesque Magazine kan geanonimiseerde gegevens gebruiken voor statistische of marketingdoeleinden.

11. Overmacht

  1. Bondesque Magazine is niet aansprakelijk voor tekortkomingen als gevolg van overmacht.
  2. In geval van overmacht heeft Bondesque Magazine het recht de uitvoering van de overeenkomst op te schorten of te ontbinden zonder verplichting tot schadevergoeding.

12. Klachten en Geschillen

  1. Klachten over het product of de levering dienen binnen 14 dagen na ontvangst schriftelijk te worden gemeld.
  2. Bondesque Magazine zal klachten zo spoedig mogelijk en naar redelijkheid behandelen.
  3. Geschillen worden bij voorkeur in onderling overleg opgelost. Indien dit niet mogelijk is, wordt het geschil voorgelegd aan de bevoegde rechter in Nederland.

13. Toepasselijk Recht

Op deze Voorwaarden is uitsluitend Nederlands recht van toepassing, met uitzondering van verdragen die een andere jurisdictie voorschrijven.

These general terms and conditions (“Terms”) apply to all offers, orders, and deliveries by Bondesque Magazine (“We”, “Us”) to its customers (“Customer”). By placing an order, the Customer agrees to these Terms.

  1. Bondesque Magazine / We / Us: the publisher and seller of Bondesque Magazine, registered in the Netherlands.
  2. Customer / You: any natural or legal person who purchases products from Bondesque Magazine.
  3. Product: any physical copy of Bondesque Magazine.
  4. Website: the official online sales platform of Bondesque Magazine.
  5. Force Majeure: any circumstance beyond the reasonable control of Bondesque Magazine that makes it temporarily or permanently impossible to fulfil obligations, including but not limited to natural disasters, pandemics, strikes, government measures, and transport issues.

2. Applicability

  1. These Terms apply to all offers, orders, and deliveries by Bondesque Magazine.
  2. Deviations from these Terms are only valid if confirmed in writing by Bondesque Magazine.
  3. The Customer’s general terms and conditions are explicitly rejected.

3. Offers and Quotations

  1. All offers are without obligation unless explicitly stated otherwise.
  2. Bondesque Magazine reserves the right to change prices, specifications, and availability without prior notice.
  3. An order constitutes a contract once Bondesque Magazine has received payment and sent an order confirmation.

4. Orders and Conclusion of Contract

  1. Orders can only be placed via the Website or other approved sales channels.
  2. Bondesque Magazine reserves the right to refuse an order, for example, in case of suspected fraud, insufficient stock, or incorrect information.
  3. All contracts are recorded electronically and are accessible to the Customer via email confirmation.

5. Prices, Payment, and Collection

  1. All prices include VAT and exclude any shipping costs, unless otherwise stated.
  2. Payments can be made via iDEAL, PayPal, Apple Pay, or credit card.
  3. Bondesque Magazine reserves the right to require payment in advance for large or international orders.
  4. If payment is not made on time, the Customer shall owe statutory interest from the due date, as well as all reasonable collection costs, including extrajudicial costs.
  5. Bondesque Magazine reserves the right to suspend order fulfilment in case of suspected payment risk.

6. Delivery and Transfer of Risk

  1. Delivery takes place at the address provided by the Customer.
  2. The risk of loss or damage passes to the Customer upon receipt of the Product.
  3. Bondesque Magazine aims to deliver orders within 7–14 working days. Longer delivery times may apply for international shipping.
  4. If delivery is delayed due to circumstances beyond the control of Bondesque Magazine, the Customer will be informed and may not terminate the agreement.

7. Right of Withdrawal and Returns

  1. Consumers within the EU have a statutory 14-day right of withdrawal.
  2. The Product must be returned in undamaged condition and in its original packaging.
  3. The Customer bears the cost of return shipping unless the Product was received damaged or defective.
  4. Bondesque Magazine will issue a refund within 14 days of receiving the returned Product.

8. Liability

  1. Bondesque Magazine is not liable for indirect damage, consequential loss, or loss of profit.
  2. Total liability is at all times limited to the invoice amount of the order.
  3. Bondesque Magazine is not liable for damage caused by external delivery services, customs, or force majeure.
  4. The Customer indemnifies Bondesque Magazine against claims from third parties related to the use of the Product.

9. Intellectual Property Rights

  1. All content of Bondesque Magazine, including texts, images, logos, graphic elements, and digital content, is protected by copyright and other intellectual property rights.
  2. Without prior written consent from Bondesque Magazine, it is prohibited to copy, distribute, or use the content commercially.

10. Privacy and Data Processing

  1. Bondesque Magazine processes personal data in accordance with the GDPR and the privacy policy of Bondesque Magazine.
  2. Personal data is used solely for processing orders and customer service.
  3. Bondesque Magazine may use anonymised data for statistical or marketing purposes.

11. Force Majeure

  1. Bondesque Magazine is not liable for failures caused by force majeure.
  2. In the event of force majeure, Bondesque Magazine has the right to suspend or terminate the fulfilment of the agreement without any obligation to pay compensation.

12. Complaints and Disputes

  1. Complaints about the Product or delivery must be reported in writing within 14 days of receipt.
  2. Bondesque Magazine will handle complaints as soon as possible and in a reasonable manner.
  3. Disputes will preferably be resolved amicably. If this is not possible, the dispute will be submitted to the competent court in the Netherlands.

13. Governing Law

These Terms are governed exclusively by Dutch law, except for treaties that prescribe a different jurisdiction.
